检视与破解:裁判文书制作问题探讨——基于百份裁判文书的实证分析

摘　　要：裁判文书的制作质量直接影响到案件当事人对判决结果的认同程度。文章从实质内容角度分析阐释了司法实践中裁判文书未完整记载案件审理中的程序性事项,未全面客观地表述当事人之间的争议,未完全展示认定事实的心证过程,未充分论证裁判结果适用法律的正当性,未恰当运用语言文字及标点符号等问题,提出裁判文书制作中如何厘清案件事实及争议的全面客观阐述、如何实现心证过程的展示及法律适用的论证方面的对策。The making quality of judgment writings will affect the degree of identity of litigants for the judge directly. By analyzing the essential contents, the article finds that some judgment writings fail to record the process of the judgment, don＇ t make clear about the disagreement of the litigants, ignore the evaluation process of evidence, and fail to explain the justice of the law for the judgment, even there are some of the judgment writings with misused words or punctuation marks. It is necessary to provide a countermeasure for how to make clear about the facts and disagreement to make judgment writings with a high quality.
