46例有刑事责任能力的法医精神病学鉴定案例分析

摘　　要：目的:探讨鉴定为有刑事责任能力的精神障碍者与所患精神疾病间的相关性。方法:收集我院2006-2010年46例鉴定为完全或限定刑事责任能力的法医精神病学鉴定案例进行统计分析。结果:被鉴定为完全或限定刑事责任能力者文化素质普遍较低,年龄多为青壮年,其中无精神病与有精神障碍者分别占17.39%、82.61%。结论:在法医精神病学鉴定中应明确诊断,谨慎评定刑事责任能力,维护司法公平正义,保护当事人的合法权利。Objective:Discuss relativity between mentally disordered person which have criminal responsibility between the person identified as mentally ill.Methods:The 46 cases were collected which were identified as full or diminished criminal responsibility of the forensic psychiatric appraisal cases for statistical analysis in our hospital between 2006-2010 years.Results: Those who were identified as full or diminished criminal responsibility were generally low cultural quality,age was more young adults,in which no psychiatric and mental disorders were accounted for 17.39%,82.61% respectively.Conclusions: Identification in forensic psychiatry should be a clear diagnosis,careful assessment of criminal responsibility,safeguard judicial justice,to protect the legitimate rights of the parties.
