体育公共产品政府供给行为的监督途径——兼论我国体育公共产品性质

摘　　要：政府提供体育公共产品是为了满足公民物质文化需求中的健身需要,健身需要是公民发展性权利的主要构成之一。由于我国"命令式"的特色行政体制结构,体育公共产品的需求主体(公民)和供给主体(政府)形成了一种非对称的权利义务关系,政府的不作为行为具有隐蔽性。研究认为,以国家机关、社会组织为主要诉讼代理人的司法救济并非督促政府行动的唯一途径,通过代表议案建议督办、公民或公民团体信访与听证等途径,充分挖掘第三方监督机制及需求主体自身来要求政府保障公民健身需要。The government provides public sports products to fulfill the fitness needs which belong to the material and cultural needs of citizens.Fitness needs is the main components of human developmental rights.Because of our country ＂authority＂ features of administrative system structure,the needs of the public sports product＇s main demander（citizen） and supplier（government） formed a kind of symmetrical rights and obligations,the government＇s nonfeasance behavior is inconspicuous.Using the organs of state,social organizations as mainly legal representatives are not the only ways to supervise government behavior,the non-legal method system such as representative＇s motion,suggestion by letters and visits,hearing should be taken.If so,the third party and demander（citizen） can keep superintending,and request the government guarantee citizens body-building needs.
