摘 要:地方人大常委会的监督权具有鲜明的特点,其主体为地方人大常委会集体;客体是本级人民政府、人民法院和人民检察院的工作;行使方式是通过听取报告等形式监督客体的工作情况,通过审议、批准和决定等手段实施监督权。地方人大常委会的监督权的性质属于外部监督,也属于事后监督。实践表明,地方人大常委会的监督工作是有成效的,但还不令人满意。其原因在于监督后的法律责任追究制度不完善、地方人大常委会人员组成制度不科学。建议完善《监督法》等相关法律,提高地方人大常委会监督效力和监督能力,改革地方人大常委会运行机制,提高其办事效率。The supervision right of the local People's Congress' Standing Committee has some distinctive features.Its subject is the local People's Congress' Standing Committee.Its object is the People's Government,the People's Court and the People's Procuratorate of the same level.Its exercise style is to supervise their work by listening to their reports and to implement its supervision right by deliberation,sanction and resolution.It is a kind of external and afterwards supervision.Its practice shows that its supervision is effective but not satisfactory because of the imperfect legal liability system and the unscientific membership system of the Standing Committee of local People's Congress.This paper proposes perfecting the supervision law,improving the supervision ability,reforming its operation mechanism and improving its efficiency.
