我国可适用于图书馆的著作权例外规定及其适用障碍剖析

摘　　要：归纳图书馆当前开展资源建设与信息服务的种类及其涉及的著作权例外,结合我国当前著作权相关法律中有关图书馆可适用的著作权例外规定,采用文本分析、问卷调查和专家访谈的方法进行论证,认为我国在这方面的立法相当薄弱。立法的不足,再加上我国图书馆界对可适用于图书馆的著作权例外知晓程度不高、充分利用图书馆可适用的著作权例外的意识不高和积极反映可适用于图书馆的著作权例外立法诉求的积极性较弱等因素,使得我国可适用于图书馆的著作权例外规定在实际应用上遭遇障碍,最终并未能充分、有效地给我国图书馆开展资源建设与信息服务带来推动作用。The paper summarizes the ongoing resource development and information services that relates to copyright exceptions. Combining with the current copyright exceptions applicable to library world, the author points out that legislation in China in this area is rather weak, based on text analysis, questionnaire survey and expert interviews. Lack of legislation, low awareness of copyright ex- ceptions applicable to library world, weak consciousness to fully make use of copyright exceptions applicable to library world, and lack of enthusiasm to make an appeal for copyright exceptions applicable to library world, as well as other factors, make the practical appli- cation of copyright exceptions applicable to library world encounter obstacles. Consequently, the development of library information re- sources construction and information service provision ultimately could not be promoted adequately and effectively.
