摘　　要：2011年1月,《国有土地上房屋征收与补偿条例》取代了备受诟病的《城市房屋拆迁管理条例》,但各地拆迁纠纷与矛盾并未销声匿迹,地方政府依然面临"拆迁难"的困境。要从根源上解决问题,必须从相关规范公权力的法律文本角度重新解读城市拆迁中政府角色的规范定位,重新界定政府的应然职责。In January of 2011,＂The Ordinance of Housing Levy and Compensation Onstate-owned Land＂ replaced ＂The City Housing Demolition Management Ordinance＂ that had the public attack.But the local government still faces the relocation＇s difficult situation.To solve the problem,we must unscramble the roles of government according to the power law and reconstruct the responsibilities of government that ought to be.
