南京国民政府时期边疆地区的司法改革及特殊政策论析

摘　　要：南京国民政府时期,当局尝试在边疆地区推行司法改革,但由于内忧外患导致司法资源不足而没有大进展。不过,基于适应边疆地区的特殊性与维护国家法制统一的考虑,有关各方围绕边疆地区的司法依据和法律适用、司法体制和法律组织以及司法人员职业化建设等问题进行了探索。但实施特殊政策,还不能满足边疆地区经济社会发展落后、少数民族生产生活方式特殊的客观要求,可谓提出问题有余、解决问题不足。During the period of Nanjing National Government, the authority tried to push on the frontiers judicial reform, because of the shortage of the judicial resources which due to the internal and external problems, the reform had little progress. However, for adapting to the particularity of borders and maintaining the national legal system, the various parties concerned proceeded the judicial basis, the application of law, as well as the judicial personnel professionalism formation. Nevertheless, the special policies still could not meet the objective requirement of the border areas.
