主要国家图书馆界对图书馆可适用的著作权例外诉求研究

摘　　要：国际性图书馆组织在著作权例外方面的诉求可以作为我国图书馆反映可适用于图书馆的著作权例外诉求的重要参照与依据,而且国家性图书馆协会或国家性图书馆在此方面的诉求,也可以成为我国图书馆界在反映著作权例外诉求方面的借鉴对象。本文以美国、英国和日本等国家为实例分析对象,剖析这些国家图书馆协(学)会或国家性图书馆对可适用于图书馆的著作权例外的立场与态度,指出图书馆界需要有效、及时地反映自身对可适用于图书馆的著作权例外的诉求,以此更为说理有力地向有关立法机构提出网络环境下适用于图书馆的著作权例外的立法修订建议。Demands of copyright exceptions applicable to library world that are brought forwards to by international library organizations can provide reference for library world in China. And the appeal to this from national library associations or national libraries can be also reflected in demand of copyright exceptions applicable to library world in China. Taking the United States, the United Kingdom and Japan for an example, the article analyzed the position and attitude about copyright exceptions applicable to library world, pointing out that library community should effectively and timely reflect their own demands for copyright exceptions, so as to more effectively give legislative revision suggestions to legislative bodies under network environment.
