摘　　要：人口老龄化问题业已成为世界各国和社会各界普遍关注的重大问题。在这种情形下,特别需要对老年人权益加以关注。老年人权益保障具有其人道主义道德基础和社会契约理论基础。借鉴老龄问题出现较早国家特别是日本等国对老年人权益保障的成功经验,结合本国实际,从完善和落实与老年人权益保护相关的法律规范入手,同时也要加强社会机制和人文环境等各个方面的建设,从而使老年人权益得到全面、有效的保护。其路径包括法律途径和法律外其他手段,如社会保障、文化道德建设以及自我保护方法等。而从模式上,则有自力救济、家庭帮助、社会救助和政府作为等,我们提倡综合运用上述各个模式的有效结合来加强对中国老年人权益的保障。The rights guarantee of the elderly has the moral basis of numamtanism and social contract theory. We should borrow the successful experience from foreign countries to improve and better the law, and at the same time to strengthen the social mechanism, humanistic environment and so on so that the fights of the elderly may be guaranteed. The approaches include law and other means, such as social security, construction of culture and morality, and self - protection. We should advocate the comprehensive mode, such as self- protection act, family aid, social help, governmental action and so on, to strengthen the protection of the elderly rights.
