规制失灵:城市居住社区体育用地法规正当性缺失与补救

摘　　要：坚持《中华人民共和国立法法》的精神及基本原则,通过对建筑规划领域和体育部门相关法律法规梳理与比较分析,认为城市居住社区体育用地法规正当性缺失是导致体育用地供给失衡、社区体育设施不足的主要原因之一。在对社区体育用地公益性的法理辨析基础上,主张"划拨用地";并强调关注弱势群体:"别把保障性住房建成现代贫民窟";提出公共服务"下沉"到居民小区:建设五级大众体育健身设施网络整体构思,以及城市社区体育用地法规正当性补救的建设性意见。This paper adhered to legislation law and its principle, through the study of architec- ture planning and design and sports departments laws, considered that urban residential sports land lack of legitimate regulations was the one of the primary reasons of lead to the imbalance of land supply problems and sports facility insufficient. Based on jurisprudence analysis of the ＂ public welfare＂ of urban residential sports land, we advocated ＂the allocation of land＂, and paid attention to the inferior Group. Meanwhile, this paper put forwards that public service should coverage urban district, and constructs five levels sports fitness facilities network. Lastly, four effective and feasible suggestions are planned to remedy the legitimacy gap.
