话语与权力秩序的构建——地方政府官员言论规制断想

摘　　要：官员"雷人雷语"的实质是权力秩序的紊乱以及人民作为主权者地位的缺失。官员言论的失范是权力异化的一种表现形式。通过法律手段规制官员的言论,是限权政府的要求,是政治和行政伦理的需要,也是改善官民关系,实现社会和谐的必由之路。因此,只有对官员言论的规制法定化,构建多层次问责机制和多元的民主监控机制,才能有效地改善官员话语及背后的权力秩序。Government officials with shocking speech exposed the truth-the chaos of power order and people lose the status of sovereign position.Officials＇ inappropriate speech is led by the absence of rules,power corrupts and the deteriotation of relationship between officials and the public.Such speech is also the forms and evidence of alieration of power.Legal regulation of officials＇ speech is not only the demand of limitation of government power and Politic Ethic and Adminstrate Ethic,but also the key way to maintain a harmonious society and improve the relationship between officials and the public.Regulation of officials＇ speech and power order can be strengthen only by law,muliti-level accoumtability mechanism and remedy,and diversifying democratic superivsion system.
