摘　　要：新功能主义是一种有着广泛影响的欧洲一体化理论,运用该理论对欧盟司法与内务合作进行分析和解释具有重要的意义。本文在总结新功能主义理论主要思想的基础上,试图对欧盟司法与内务合作进行理论解读。新功能主义认为,欧盟司法与内务合作的产生与发展是溢出效应的体现和结果;超国家机构在该领域中地位和作用的不断提升是欧盟司法与内务合作发展的重要成果和衡量尺度;欧盟司法与内务合作的发展动力源自于欧洲一体化进程中溢出效应产生的压力;欧盟司法与内务合作的发展提升了欧洲人对超国家机构的政治认同,促进了欧洲公民将其政治效忠从民族国家政府向欧盟超国家机构的转移。According to Neo-Functionalism,the developing process of the Cooperation on Judicioal and Home Affairs in the EU is the performance and result of spill-over effect;the increasing importance of supranational organizations in this field is the great achievement and measurement of the Cooperation on Judicial and Home Affairs in the EU;the impetus to the Cooperation on Judicial and Home Affairs in the EU comes from the pressure of spill-over effect;the development of the Cooperation on Judicial and Home Affairs in the EU increases European citizens' political identity to the supranational organizations and promotes the process of European citizens' loyalty shift.
