基于规划法的规划许可社会秩序辨释与探微

摘　　要：从城乡空间利用秩序角度指出规划许可的角色和渊源,论述了许可的基本特征,并以建设用地规划许可证制度和建设工程规划许可证制度为实证展开研究,辨释了其许可行政制度环境建设的若干问题。在公共行政监督秩序中,从四个方面指出当前亟需加强监督社会学等研究。最后提出并阐述了依产权的公私属性不同进行三分的设想,即将规划许可分为公益资产许可、公有资产许可和普通许可三种类型。Starting with the origin and history of planning permit in urban-rural spatial use order, this paper examines the basic characteristics of planning permit. Based on the empirical study on the Land Use Permit System and Building Permit System, it analyzes related issues in the administrative institutional development of planning permit. It also argues to strengthen the study of supervision sociology in public and administrative supervision from four aspects. Finally it proposes to classify the planning permit into public welfare, state-own, and general categories according to the attributes of the property rights.
