摘　　要：探究地役权必须首先明确地役权的概念、渊源、特征以及本质,地役权的本质在学术界众说纷纭,试从现有的学说入手,分析各种学说的可取之处和不足之处,从而得出合理的结论,为地役权的研究打好基础。Easement originated in ancient Rome,the usufructuary right constitutes the easements system with its unique institutional structure rules,especially the land and other real estate resources.The paper argues the study of easement should be make concept of easements clear,and there are different opinions about the nature of easements.The paper tries to analyze the merits and weaknesses of the different theories,and then to make a reasonable conclusion for an easement to lay the foundation of the study.
