“选民联名推荐代表候选人”如何联名?——梁树新事件的法律思考

摘　　要：选举法规定的"选民十人以上联名,也可以推荐代表候选人"中的"联名",社会常人的理解与专业机构理解以及实际操作有巨大差距,如果缺少明确操作指引,或者缺少专业服务,冲突的发生是必然的,消除冲突,明确选民提名操作程序,做到选举操作的规范化、透明化,实现常人理解专业术语背后的意义,选举法必须回应公民主体意识增强的现实而完善。Voting Rights Act stipulates ＂more than ten voters who sign jointly are entitled to recommend candidates＂.The public＇s interpretation of ＂sign jointly＂ varies,and there is a dramatic gap between the interpretation of the professional agencies and practical operation.Conflicts are inevitable if lacking explicit operation instructions and professional services.To eliminate conflicts,specify the procedure of nomination,standardize and demystify the election operation and to realize the public＇s interpretation of technical terms,Voting Rights Act should be refined in response to the enhancement of civil subject consciousness.
