摘　　要：伴随中国互联网产业的快速发展出现了网上商品侵权交易的突出问题,政府部门开展互联网侵权交易监管不但存在着理论上的困境,还要面对政策支持不力、外部机构协调困难和内部组织不适应等三方面的难点,因此,围绕网上侵权交易的特点,政府需要进行适应性的变革,在有限的监管空间中寻找可行的路径,达到互联网自由发展和侵权交易有效监管的平衡。Based on the case of cigarettes, this paper introduces the problem of illegal cigarettes trading on the internet, explores the theoretical dilemma of its regulation, and points out the key points for practice on policy, external coordination and internal organization. We find that focusing on the characteristics of the illegal internet trading, the government needs to conduct some adaptive changes, search for possible regulatory path in the limited space and keep the balance between the free development of internet and the effective regulation of internet trading.
