摘　　要：正当业务行为形式上符合犯罪构成的特征,其正当性的根据在于它是一种具有机能作用的社会相当行为,且保护和促进的法益要大于所侵害的法益。正当业务行为具有人权、正义和自由的价值,我国刑法有必要予以法规化。The proper professional act formally conforms to the characteristics grounds of legitimacy lie in a kind of socially accepted behavior with functional is protected and promoted, are greater than the value of freedom, the proper professional action damaged ones.
