This article explores the complex relationship between public trial and fair trial and the experiences of the Japanese courts in striking a proper balance between the conflicting interests. Unlike the United States and other western states, Japan puts more emphasis on judicial fairness and lays down strict rules over the press activities like photography during trials. The article first discusses Japan's traditional limits on public trial and the stages in which they developed. It then discusses the landmark case in 1989 and the institutional progress since, and finally delineates the current Japanese regulation on courtroom photography and broadcasting. From the contemporary trend, it seems that Japan will opt for more public trials in future. With the continuous efforts of the Japanese press and general public, the Japanese courts will properly accommodate the needs for judicial transparency and judicial fairness.
