摘　　要：土地征收行政复议案件具有明显的特殊性,作为申请人的土地权利人的情况比较复杂,导致复议案件中申请人资格的认定有一定难度。在具体的复议案件中,申请人的认定除依据一般标准外,还应考虑申请人提起复议所针对的具体行政行为,视不同具体行政行为来判定申请人是否适格,可以减轻申请人认定的难度,对于提高土地征收行政复议案件审查的效率、维护申请人的合法权益,都具有积极意义。Cases of land expropriation administrative reconsideration have obvious particularity. The situation of the land rights holders, as applicants, is more complex, which makes it harder to recognize the qualifications of the applicants in the administrative reconsideration. This article holds the view that the identification of the appli- cants in specific cases, except pursuant to the general standards, the specific administrative action which the applicants bring against should also be taken into consideration so that whether the applicants are qualified or can not be judged based on such different specific administrative action, which is of great positive significance that it can alle- viate the difficulties of applicant identification, improve efficiency of the administrative reconsideration of land expropriation, and safeguard the legitimate rights and interests of the applicant in a timely manner.
