试论土地征用补偿纠纷的司法救济——以重庆法院审判案例为视角

摘　　要：近年来,土地征用补偿行政案件已成为行政审判的一大热点、难点。基于重庆法院审判案例的实证分析,发现土地征用补偿行政案件具有影响面大、政策性较强、审理难度大、息诉服判率低的特点。其原因在于:土地征用补偿立法滞后与补偿标准不合理。因此,必须健全土地征用补偿立法,充分发挥审判权能动性以实现权益保障与经济发展的双赢。Recently the disputes of land expropriation compensation have become the focus of the administrative cases.Based on the case studies in Chongqing Courts,the researches find that the cases of land expropriation compensation have their own characteristics,such as the enlargement of influence,strong policy consideration,difficulty elevated for the judgment and the low rate of willingly accepting the judgments.According to analysis,the reason for it is that the law of land expropriation compensation is lagged behind and the standard of compensation is unreasonable.So it is necessary to perfect the law of land expropriation compensation to realize the function of the administrative case to benefit the interest protection and economic development.
