老年人再婚现状分析与法律保障机制研究——以成都市为例

摘　　要：我国正处于经济结构和社会结构重大变革时期,人口快速老龄化与思想观念深刻变化相伴随,成都市出现隐婚老年群体,但却不得不面临其中存在的风险和人身、财产权益无法受法律保障的现实。即使有些老人合法再婚,但再婚后离婚的老年人远比原配夫妻离婚的多得多,且离婚率在逐年增加,长此以往,将影响到社会的各个方面,特别是作为社会细胞的婚姻家庭制度。这已经作为社会现实问题对《婚姻法》、《老年人权益保障法》等法律和婚姻法适用等问题提出了修改的要求。本文以对成都市老年人再婚现状的实地调研为基础和样本,剖析了老年人再婚所面临的困境,并提出法律权益保障机制的具体、可操作的对策建议,从预防和化解因老年人再婚而产生的各种纠纷、矛盾为视角,最大限度地减少不和谐因素,最大限度地增加和谐因素,把该问题的解决作为社会管理创新一项实实在在的问题提出来,以期引起更大的关切和讨论。China is during a major economic and social structure change Period,rapidly aging population and accompanied by profound changes in ideas,there is hidden marriage elderly groups in Chengdu,but it had to face the risks of which Personal and property interests can not be protected by law.Even some elderly people remarried legally,after marriage,the divorce rate in the elderly increases every year and much more than the first wife divorce.Long past,it will affect all aspects of society,especially marriage and family field,whice is usually used as a social system of the cell.It is a a social reality and require ＂Marriage,＂ ＂elderly Protection Act＂ and other applicable laws to be modified.In this paper,the status quo of the remarried elderly Chengdu-based and field research sample,analysis of the difficulties faced by older people to remarry,and legal mechanisms to protect the interests of specific,actionable policy proposals,from the elderly to prevent and resolve because of remarriage for a variety of disputes,conflicts of perspective,the maximum and reduce disharmonious factors to maximize the increase harmonious factors and the the solution to the problem as a real innovation in social management issues,so as to arouse more concern and discussion.
