公益林生态补偿基本原则构想

摘　　要：法的基本原则是整个法律活动的指导思想和出发点,公益林生态补偿应首先确定基本原则来指导公益林生态补偿的立法及实施。文章立足国内原有公益林生态补偿的基本理念以及国内公益林生态补偿的具体国情,借鉴国外先进立法经验,提出了确立效益原则、公平原则、利益权衡原则,利用者补偿原则和公众参与原则为公益林生态补偿基本原则的构想。The basic principle of law is the guiding ideology as well as the starting point of the whole legal activities.As for public forest ecological compensation the basic principles should be first determined to guide the legislation and implementation of forest eco-compensation.This paper is based on the basic idea of the originally domestic forest eco-compensation and the specific condition of our nation,together with advanced legislative experience from foreign countries.So we put forward the idea to establish efficiency,equality,mutual benefits,user compensation and public participation,as the basic principles of public welfare forest ecological compensation.
