摘　　要：亲属容隐制度是我国传统法律文化中的一项代表性制度,也是中华法系伦理化的一个重要表现,它曾伴随中国传统法律发展的全过程。虽被新中国法律所摒弃,但其对人性伦理关怀的价值追求并不必然与现代刑律精神相违背。今天需要我们对这一制度重新认识,在历史考察的基础上,探求分析其重构的法理依据并予以合理构建。Family concealment system is a representational system in traditional law culture of China.It is also an important symbolization in ethical of ancient Chinese law system and an accompanying system of the development of traditional Chinese law.Although it has been banished by the law of new China,its pursuit of the value of human ethical care is still adaptable to modern spirit of criminal law.The current situation needs us to re-know the family concealment system,discover and analyze the legal basis of its reconstruction and construct it reasonably based on historical observation.
