摘 要:建设工程合同法定解除权发生条件,需要根据该类合同的特殊性进行具体化,承包方非法转包和违法分包、发包人不履行协助义务、发包人提供的材料不合格等情形下,均可发生法定解除权;此外,发包人还享有任意解除权,可以赔偿损失为代价,单方解除合同。解除权受除斥期间的限制,建设工程合同的解除通常不发生溯及既往的效力,违约解除时的赔偿请求权在性质上为违约损害赔偿请求权。The predisposing factors of the legal right to terminate construction contracts need to be materialized according to the particularity of the contracts.If the contractor illegally subcontracts or the employer fails to fulfill the obligation to assist,provides unqualified materials,the legal right to terminate construction contracts can be applyed.In addition,the employer also enjoy freewill right to terminate construction contracts unilaterally,but in cost of compensating for the losses.The legal right to terminate contracts is limited by the period of right.The termination of construction contracts usually doesn't have retroactive effectiveness.The compensation claim of illegal termination is in nature the claim of compensation for breaching the contracts.
