摘　　要：老有所养、农民社会保险权、中国农民的特殊性、统筹城乡发展、国家财政收入快速增长,分别构成新农保立法的伦理基础、权利基础、社会基础、政策基础和经济基础。新农保立法具有相应的根本法律依据和一般法律依据,保障农民社会养老保险权与我国经济发展水平相适应,统一性与灵活性相结合构成了新农保的立法原则。立法可以提升农民对新农保的良好预期,可以明确新农保在我国社会经济生活中的重要地位,可以为新农保提供基本的法定标准和法律制度框架,可以妥善安排好不同农村社会保障制度之间的衔接,可以为我国农民社会养老保险权的实现提供法制保障。Supporting the old,farmer′s social insurance rights,Chinese farmer′s particularities,balancing the development of urban and rural areas,and rapid growth of national financial income respectively form the ethics foundation,rights foundation,social basis,policy basis and economic basis of the legislation of new rural social pension insurance.The legislation of new rural social pension insurance has a corresponding fundamental legal basis and common legal basis,adapting the safeguarding of farmer′s social insurance rights to economic development level of our country,and combining unity and flexibility construct the legislation principles of the new rural social pension insurance.Legislation can improve the farmers′ good expectation about the new rural social pension insurance,can clear the important position of it in China′s social and economic life,can provide it with basic legal standards and framework of the legal system,can properly join different rural social security systems together,and can provide legal safeguarding for the realization of farmer′s social insurance rights.
