民间习惯在民事调解中运用的法理分析

摘　　要：民间习惯作为一种内生于社会的"本土资源",在我国法治进程中,对于民众的日常生活发挥着重要的规范作用。在我国学界,司法活动中民间习惯的适用也引起了学者的普遍关注和研究。笔者以民事调解制度为背景框架,探讨民间习惯在民事调解中的运用,并在此基础上试提出国家对于民事调解活动中运用民间习惯的规范和引导措施。本文一方面希望为民间习惯在司法实践中的运用寻找一个更为适宜的语境,另一方面通过论证在民事调解中适当引入民间习惯的可行性,以期促进调解制度的解纷功能进一步发挥,更好地应对和解决我国目前社会转型时期所出现的各种矛盾纠纷。The folk custom,as the ＂local resources＂ of our society,plays an important regulatory role in people＇s daily life in the process of constitutionality.In our Academic circles,the application of folk customs in the judicial activity also causes widespread concern of scholars.The author try to use the civil mediation system as the background framework,explore the application of the folk customs in civil mediation,and try to put the country＇s guidance measures and norms of civil mediation activities in the use of folk customary.On the one hand we hope for providing the folk custom in the judicial practice for a more appropriate context,on the other hand,we prove the feasibility of folk custom in the civil mediation,in order to promote the civil mediation system＇s function of resolving disputes and various contradictions during the period of transformation in our current society.
