论我国反垄断法适用除外制度的价值取向

摘　　要：反垄断法是反对、限制垄断和保护竞争的法律制度,是现代经济法的核心组成部分。我国的反垄断法已经颁布并实施,同时在某些特殊的行业或领域内,该法也确立了适用除外制度。本文从反垄断法适用除外制度的涵义入手,探讨了适用除外制度在伦理道德、有效竞争、公平与效率、社会本位等方面的价值取向,并提出了进一步完善我国反垄断法适用除外制度的建议。Antitrust law is limited monopoly and protection against,the legal system of the competition,is the core component of modern economic law.China has issued and implements the anti-monopoly law,and in some special industry or area,the law also established exemption system.This paper is the meaning of antimonopoly law exemption system,discusses the exemption in moral system,effective competition,equity and efficiency,and the social standard of value orientation,and put forward some further perfect our country＇s exemption system of antitrust law.
