摘　　要：铁路安全是涉及整个社会的系统工程,需要通过立法建立具有权威性和普遍性的法律规范。介绍日本、德国、美国、西班牙等国高速铁路立法情况,分析国外高速铁路安全立法的主要内容,结合我国高铁实际,探讨如何通过立法建立高效合理的安全管理体制,完善技术规范,完善高铁事故预防及处置措施。Railway safety is system engineering involved the whole society, needs construct law standards with authority and universality by legislation. Introducing and analyzing the situation and main contents of safe legislation of high-speed railways abroad, such as Japan, Germany, United States, Spain, combining with the actual of Chinese high-speed railways, the article discusses how to construct the efficient and reasonable system of safe management, to perfect technology standards and to improve measures of prevention and disposal of high-speed railway accidents by legislation.
