三网融合背景下电信运营商网络著作权保护问题及对策

摘　　要：三网融合之后,作品资源将会更加稀缺,传播的范围将更加广泛,相应的作品价值也会提高,有利于推动网络的正版化,同时也会产生新的网络著作权问题。由于网络侵权行为非常快捷方便,其复制、发表行为几乎不存在门槛,近些年来,权利人起诉电信运营商网络著作权侵权纠纷不断,给企业声誉和经营发展造成了不利影响。从电信运营商的角度,对目前网络著作权保护存在的问题进行分析,并结合企业实际,提出相应的对策和措施,以期有利于网络著作权保护的社会氛围的形成和网络业的健康发展。After the convergence of the three telecommunication networks,there will be less resources of works,more extensive diffusion and a corresponding increase in the value of works and it is advantageous to promote the legalization of network.However,it will also bring new problems of the network copyright.Owing to its fast speed and convenience,there is almost no hindrance in the duplication and publication of internet tort.In recent years,there have been many cases of obligees＇ suing telecom operators for the tort of internet copyright.This paper has analyzed the network copyright protection problems,provided the actual situation of the enterprises and put forward the corresponding countermeasures and strategies in order to form the favorable social atmosphere for the network copyright protection and healthy development of network industry.
