摘　　要：城中村改造是一个复杂且系统的工程,涉及到村官、村民、村集体、政府、开发商多方利益,所引发的潜在经济问题也层出不穷,尤其是村官与开发商之间的利益协调问题,更是影响到我国城中村改造和基层民主建设的效果。本文从界定城中村村官身份出发,对城中村村官与开发商之间的经济行为表现作出阐述,并对此行为涉及的法律问题从刑法学角度做一分析。Urban village transformation is a complex and systematic project,which involves the multiple benefits of the village officials,the villagers,the village collective,government and developers.The potential economic problems caused by it are also emerging endlessly.Among all the problems,the harmony of interest between the village officials and the developers even impacts the consequent of China＇s urban village transformation and promotion of democracy at the grass-root level.Starting with defining the identity of the village official of the urban village,this paper expounds the economical behavior between the village officials and the developers and analyzes the legal questions these behaviors related from the perspective of criminal law.
