摘　　要：保护性治疗是为了最大限度地促进治疗效果实现,其与当前医疗中热议的"知情同意权"存在矛盾,而代理制度就是解决这一矛盾的关键。但是,代理制度中对患者本人权利的限制、代理主体的利益冲突、代理情形的细化,都是需要在立法中亟待解决的问题。针对以上问题,本文通过对其他国家以及中国保护性治疗知情同意代理制度的讨论,提出了相关的完善建议。The purpose of protective treatment is to promote the maximized realization of treatment effect, which has contradiction with the ＂right of informed consent＂ discussed highly in the clinical practice, and the agent system is the key to resolve this contradiction. However, in the agent system, the limit to the right of the patient, the conflict of interest among agents and the refinement of agent situation, are required to be solved in the legislation. To solve these problems, this paper discusses informed consent agent system in the protective treatment in other countries as well as in China, and puts forward relevant suggestions.
