摘　　要：网络环境下的版权侵权具有技术性强、手段多、地域范围广等特点。可以根据侵权的特点将其分为直接侵权和间接侵权两种类型。在认定直接侵权的责任时,应考虑侵权人的主观过错、客观行为、损害后果、损害后果与侵权行为直接的因果关系等因素。在认定间接侵权行为的责任时,应考虑侵权人的主观过错、客观行为、法定的免责条件等因素,并适当考虑网络产业发展的现实。The copyright infringement under network environment bears the characteristics of high-tech, multi- means, extensive territory, and serious results. The infringements under network environment can be divided into two types, namely direct liability and indirect liability, according to their particular features. Upon identifying whether a conduct constitutes direct infringement, we should consider the following factors, including conductor＇s subjective fault and objective behaviors, the results of infringement, and the direct causal relationship between damage and infringement.
