摘　　要：市场化改革就其本质内容而言就是权利化改革 ,否则市场经济充其量只是货币化的经济。由于法律是现代社会制度性安排的主要手段 ,因此 ,以权利为本位对市场进行制度构造是市场法律的核心内容 。The essential purpose of market reform lies in the reform of right and benefit,otherwise market economy can only be consiclered as a monetary economy.Since the law serves as the major means of systematic arrangement for the modern souiety,market structuring based on right and benefit will be the main content of market law as well as the basic requirements for administering a country by the law.
