摘 要:阐述林权抵押贷款概念及其法律依据以及云南省近年来开展林权抵押贷款基本情况.分析其中存在着金融机构由于担心自然灾害导致林权抵押灭失而使贷款风险升高,不愿开展贷款业务,林权抵押实现有一定难度,贷款数额较小等问题.藉此,提出了借鉴国外森林保险立法经验,降低和转移林权抵押贷款风险;利用反担保制度解决林农林权抵押贷款难;组建林业担保公司等对策或建议.This paper describes the concept of forest ownership mortgage loan and its legal basis as well as the basic situation of Yunnan Province forest right mortgage loan system in recent years.Existed problems i.e.,a certain degree of difficulty to achieve forest right mortgage loan or the small amount of the loan due to financial institutions do not want to carry out loan business for fears of natural disasters lead to lost in the forest right mortgage loan and to elevate risk.In this way,to draw on the legislative experience of foreign forest insurance,to reduce and transfer forest rights mortgage loan risk;using counter-guarantee system to solve difficulty of forest ownership mortgage loan;to built forestry guarantee Corporation etc,recommendations have been carried out.
