维稳思维下我国行政救济制度的反思与出路

摘　　要：建立完备、有效的行政救济制度是社会管理创新的重要组成部分。在当前维稳思维下,我国现有行政救济制度的内在机制与外在运行模式存在着诸多不足。行政相对人的权利救济渠道不畅,不仅激化了社会矛盾,也影响了社会稳定。社会主义和谐社会应当是安全有序、公平正义、保障人权的法治社会。弘扬法治精神、保障行政救济机构的独立性和权威性、加强权力监督与制约、扩大行政救济范围以及畅通行政救济渠道是加强社会管理、化解社会矛盾、维护社会稳定的必由之路。Establishment of a comprehensive and effective administrative relief system is an important part of social management innovation.On the thinking of maintaining stability,there are many deficiencies in the internal mechanism and external operation mode of China＇s current administrative relief system,the executive relative＇s rights relief channel is not smooth,it not only intensifies social conflicts,but also affects the social stability.Socialist harmonious society should be the rule of law that is safe and orderly,justice and protection of human rights.To promote the rule of law,to protect the independence and authority of administrative relief agencies,to strengthen supervision and restraint of the powers,to expand the scope of administrative relief and to flow channels of administrative remedies,is the only way of strengthening social management,resolving social conflicts and maintaining social stability.
