摘　　要：权力与权利的理论是法学研究中的重要课题,许多法学家都进行了富有成果的探讨,但仍存在很大的争议,权力起源的理论仍有待于进一步明确。权力自身并不存在正义或异化的原始属性,权力的存在是有一定的正当性基础的,它与权利的背离是永恒的。对权利与权力都应进行规范和约束。Theories of power and right are important issues of legal research.Many jurists have made fruitful achievements in this connection despite some considerable controversies.Theories about the origin of power should be further clarified.Power itself,in nature,is neither just nor alien,and its existence is considered to be justifiable.Power never conforms to right.Both power and right should be regulated and restricted.
