摘 要:市场上新兴品牌的崛起往往会导致相应侵权行为,特别是产生侵犯其知识产权的行为。在尊重市场竞争秩序和贯彻社会主义法治理念的背景下,综合运用已有法律制度抵御相关侵权行为是最有效的手段。目前我国知识产权保护体系并非供给不足,问题是地方品牌在实践中并没有充分利用已有制度。构建对地方品牌的知识产权保护体系首先要树立宏观层面的保护战略,这其中既要依靠政府的指导也需要厂商的主动行为。全面的保护不仅要求从商标专利等方面做到逐一对应,为了达到地方品牌效应最大化,著作权保护和"国家非物质文化遗产"保护方式也不可缺失。The rise of emerging brands in the market often leads to a corresponding infringement especially infringement of its intellectual property right. In the context of respecting the market competition order and carrying out the socialist concept of rule of law, the integrated use of the existing legal system against the relevant infringement is the most effective means.The intellectual property protection system in China is not facinga supply shortage. The problem is the local brand that did not fully utilize the existing system in practice. Building intellectual property protection system for local brand must be established a macro-level protection strategy, which should not only rely on Government guidance but also requires the active behavior of manufacturers. The comprehensive protection requires not only one by one correspondence in terms of trademarks and patents. The copyright and the "national intangible cultural heritage" protection methods can not be missed in order to achieve local brands to maximize the effect.
