摘 要:近年来频繁发生的拆迁暴力事件促成了《国有土地上房屋征收与补偿条例》的出台。本文从"公共利益"的判定、补偿机制的修订、救济途径的改变、"司法强拆"的实施这四个着眼点探讨了新条例的进步性与局限性,从新条例的借鉴意义和农地征收实践中面临的困境两个方面讨论了农村征地制度改革的可行思路。Frequent acts of violence in recent years in consequence of housing demolitions led to the promulgation of Rules Regulating the Expropriation of and Compensation Land.
