摘  要:侗款文化是我国侗族地区的特色文化。侗款文化的核心侗款在本质上是民间法、习惯法,能够起到社会控制的作用。侗族款文化虽然包含了很多积极因子,但是由于民间法、习惯法本身与现代法治之间存在一定的冲突,因而侗族款文化与现代法治之间并不完全吻合,两者之间存在习惯法与国家法冲突的一切表征。当然,这种冲突与矛盾并非不能化解。如果能够有效地化解两者的矛盾冲突,则能够进一步发挥侗族款文化的积极意义,与现代法治形成互补作用,促进少数民族地区法治的实现。The Kuan culture of Dong ethnic group is distinctive in the Dong area in China. The core of Kuan culture is that it is folk law and customary law in nature. It plays the role of social manipulating. Although Dong's Kuan culture belongs to folk law and customary law with many positive effects, it does not fit closely with modern government by law because folk law and customary law clash to some extent with modern government by law. The conflict between the two resembles in all aspects the conflict between customary law and national law. If the conflicts between the two can be solved effectively, Kuan culture can play a constructive role and is complementary with modern government by law, thus accelerating the construction of society ruled by law.
