摘　　要：风俗习惯在民事调解中的适用体现了司法国情的特殊性、司法制度的文化内涵与和谐社会的法治要求,有其必要性。风俗习惯适用于民事调解存在体制保障的缺失、缺乏必要的调查和汇编、法官适用风俗习惯的意识有待加强等方面的困境。我国应该通过建立完善的善良风俗的认定标准、加强对民众利用善良风俗习惯的引导、整理善良风俗习惯和汇编风俗习惯司法适用案例、加强法官群体对风俗习惯学理的认识与学习等方面的措施,为风俗习惯在民事调解中的适用提供保障。The application of folk customs in civil mediation is necessary because it embodies the particularity of judicial situation of our country, cultural connotation of judicial system and legal requirements of harmonious society. The application of folk customs in civil mediation encounters the predicament of lacking systematical support and necessary survey and compiling, and judges＇ awareness of applying customs needs improving. China should provide safeguard for the application of customs in civil mediation in the following ways： establishing perfect ascertaining criteria for customs, enhancing the guidance for the public to make use of good customs, sorting out the data of good customs and compiling cases of applying customs, enhancing judges＇ understanding and learning of theory custom.
