也论物权效力

摘　　要：物权的效力是由物权的本质属性所决定,而物权是民事主体对特定物进行支配的权利,所以物权的效力是由权利人对特定物的支配这一本质属性所折射出来的必然要求。在具体规范层面,物权的效力表现为物权的排他效力和物权的优先效力,物权请求权和物权人对物的追及权属于物权的排他效力的范畴,而不是单独的物权效力,物权的优先效力仅指物权优于债权,并存之数个物权之间的效力顺位关系不属于物权优先效力的范畴。The validity of real right is determined by the essential nature of real right.Real right is a kind of right that appears its content by allowing the right holder to dominate specific substance,so the validity of real right is the necessary requirement refracted by its essential nature.Thus we can infer that validity of real right can be interpreted as the exclusive validity and the priority validity.The claim validity and retroactive validity should not be included in exclusive validity.The priority validity only means the priority validity of real right to obligatory right.
