摘　　要：《刑事诉讼法修正案(草案)》中规定了秘密侦查,但实际上具体的秘密拍摄没有得到充分重视。规定原则抽象,也没有相关配套规范,其应有的特性和功能没有体现,应当通过对比国外的法律,分析其的特点、现状、问题,寻找克服途径,以此来完善相关规范,保障其运行,为取证、获得线索、摸清犯罪集团结构、抓捕嫌疑人提供必要的条件。Draft of Criminal law announced regulates secret investigation,but actually due attention hasn＇t been paid to specific secret shoot.Criterion is principled and Abstract.It has no correlative completed rule and hasn＇t reflected due characteristic,function.By contrasting overseas law,analysing domestic feature and current situation is looking for the door to overcome problem.This will improve specifications and ensure operation,supplying condition to obtain evidence and clue,feel out structure of criminal gang,seize criminal suspect.
