摘　　要：目的提高国境卫生检疫执法能力,防止传染病的传播和流行,预防相关犯罪问题出现,保护当事人的合法权益。方法根据《中华人民共和国国境卫生检疫法实施细则》修改后的限制入境规定,结合《传染病防治法》、《国际卫生条例(2005)》和《刑法》的相关规定,研究卫生检疫执法过程中可能出现的犯罪问题,探讨可行的解决方案。结果相关规定、表述存在不明确之处,应加大法律法规的宣传力度,提高卫生检疫工作者执法水平,加强卫生检疫核心能力建设,建设高素质的卫生检疫执法队伍。结论尽快明晰相关解释,妥善应对,防范犯罪现象出现。Objective To enhance the law enforcement capacity building of frontier health quarantine,prevent the spread and prevalence of epidemic disease as well as relevant crimes,protect the legal rights and interests of the party concerned.Methods According to the modified regulations of bans on entry stipulated in the Rules for the Implementation of Frontier Health and Quarantine Law,in combination with relevant regulations of Law on the Prevention and Control of Infectious Diseases,International Health Regulation（2005） and Criminal Law,possibly emerging crimes during health quarantine law enforcement are discussed to explore feasible solutions.Results Due to the ambiguous regulations and definitions,propaganda of laws and regulations should be increased to raise quarantine officials＇ law enforcement level,strengthen health and quarantine core capacity building and construct a qualified health and quarantine law-enforcement team.Conclusion Relevant explanations should be clarified as soon as possible to properly handle and prevent crimes.
