摘  要:就业平等权作为基本人权的一项重要内容,已经成为国际人权法上普遍接受的原则。而女性就业歧视行为表现形式多样,且形成原因复杂。和谐社会下,女性就业权亟需保障,对此应当从现有法律约束和今后立法规制两个方面寻求对策,并进一步提高女性在诉讼程序中的弱势地位,为女性平等参与就业作政策、法律上的保证,逐步改善女性就业歧视现象。Equal right to obtain employment which is placed as the priority has generally been taken as a principle by the international human rights acts.However,the gender discrimination varies in the forms and it is due to lots of causes.In the harmonious society,it's a must to perfect the protection system.The government is obliged to seek countermeasures against the discrimination in women's employment right from two points,legal restriction and legislation.In addition,the lawmakers should give more cares to females who are at adverse position in the proceeding.Guaranteed by the enhanced policies and legal provisions,the women's equal employment rights can be better protected.
