摘　　要：老年人犯罪是我国在老龄化日趋严重的背景下所要必须面对的问题。而老年人的刑事责任能力的认定问题在我国尚缺乏专门性的研究,实际上它与老年人的精神疾病、智力退化以及醉酒等都有着密切的联系。The elderly crime is the problem that we have to face on the background of Chinese getting aging society.While the cognizance of older criminal responsibility is still lacking specialized research in China,in fact it is closely linked with older people with a mental illness,mental deterioration,and drinking.
