摘　　要：随着知识产权与人权的发展,二者之间的冲突出现了新的表现形式,其中当属植物新品种权与农民权之间的冲突。对植物新品种授予植物新品种权,可以激励育种者的育种热情,有利于推动我国农业的发展,但我国农村的社会保障体制不够完善,大多数农民还是依靠土地为生,农业是农民的生存之基,植物新品种又是农业的核心。因此,在保护植物新品种权的同时,必须注重保护农民权,实现两者的平衡协调发展。With the development of intellectual property and human rights,the new form of the conflict between the above appears,that is,the conflict between new plant varieties and farmers＇ rights.New plant varieties granted can inspire the enthusiasm of breeders breeding,promote the development of agriculture in China,but China＇s rural social security system is not perfect,most farmers still rely on the land for a living,agriculture is the survival of farmers the foundation for new plant varieties is at the heart of agriculture.Therefore,to protect new varieties of plants at the same time,we must focus on the protection of farmers＇ rights to achieve a balance between the coordinated developments.
