摘 要:针对目前道路运输行为管理存在的问题,从运输行为归属问题入手,综合评述运输行为归属标准,指出运输行为归属标准的多样性,是造成道路运输行为执法混乱的最重要原因。基于此,论文对运输行为重新界定分类,依据运输行为是否具有经济属性标准,把各类运输行为统一聚类为经济性运输和非经济性运输,这样可以明确执法主体的执法范围,解决执法过程中长期以来"缩小"与"扩大"尖锐对峙矛盾,为正确制定运输政策和指导实践提供理论依据。To solve the Problems in the management of road transport behavior, start from the transport attribution. Review transport behavior comprehensive, point out that the diversity of standards for transport behavior attributable is the most important reason for the confusion enforcement of road transport behavior. Based on this, the paper classify transport behavior from the new boundary based on the transport of the standard of economic attributes, cluster the behavior of various types of transportation to the economic transport and non- economic transport, that can clear the scope of enforcement of the law enforcement main to address the persistent "narrow" and " widening" the sharp confrontation between the contradictions, to provide a theoretical basis for the correct development of transport policy and guide practice.
