完善我国民间慈善事业监管制度的研究

摘　　要：我国民间慈善事业长期处于双重监管或无监管状态,给慈善事业发展带来诸多问题。慈善事业发展需要以健全的监管制度为依托。民间慈善事业的监督管理,是保障慈善事业良性运行的根本手段,是保证慈善公益捐赠资源良好管理使用、慈善事业健康有序发展的重要前提和关键。我国应构建以法律为主线、以法规和规章为依托、规范性文件为补充的法律保证体系,为慈善事业的发展提供良好的法制环境;逐步建立法人治理结构,明确内部分工,各行其职、各负其责;建立社会监督的协同机制和行业自律机制,以最终使我国慈善事业逐步走向阳光、理性、秩序的运行轨道。Our domestic civil charity project was long time under dual-supervision or non-supervision, which brings several obstacles to its improvement. Charity project should be based on a strong supervision sys- tem. A good supervision system of domestic civil charity project is the key and final way to its sustainable running and ensures that the donated resources could be well used. China should establish the legal guarantee system which takes law as the main line and rely on regulations and rules with normative documents as ad- dition to provide good legal environment for the development of charity. Gradually establish a corporate governance structure with clear part work and appropriate functions. And establish social supervision coor- dination mechanism and self-discipline mechanism so as to finally make China charity gradually move to- wards the sunshine, reason and order.
