我国行政许可后续监管法律问题探析

摘　　要：行政许可后续监管是指行政许可监管机关对行政被许可人进行督促和检查,确保被许可人履行其法定义务的行政执法行为。我国近年来发生的包括食品安全在内的一系列危及社会公共安全的问题很多都缘于行政许可后续监管的缺失。基于我国行政许可后续监管工作的现状,通过对其存在的法律问题进行法理分析,建议从权力的来源、运行及运行结果等环节加强对行政许可监管权的监督和控制,确保被许可人严格履行其法定义务,真正实现行政许可制度在社会管理中的重要功能。The follow-up supervision of the administrative license is the administrative law enforcement that the regulatory authorities of the administrative license to the licensee for supervision and inspection to ensure the licensee to perform its statutory obligations.China in recent years,including food safety there have been a series of serious problems that threatening public security which rooted in the lack of follow-up supervision of the administrative license.Based on the status work of the follow-up supervision of our administrative license,through legal analysis for the legal problems,advice to strengthen the supervision and control for the custody of the administrative license from the source of the power,run,the results and other aspects,to ensure the licensee to strict compliance with its statutory obligations,so as to realize the important functions of the administrative license system in the management of the social.
