摘　　要：医疗合同关系是一种不同于一般合同的特殊的民事法律关系,文章以民法的基本理论为依据,结合我国现实情况,力求通过对医疗合同的主体、成立、内容等问题进行研究,阐明其特殊性,为解决医患纠纷寻求理论依据,以服务于建设社会主义法治国家的需要。The medical service contract is a special civil legal relation. On the basis of the civil law and the reality, the article analyzes the characteristics in establishment of the medical contract, Furthermore the article concludes more fair and reasonable counter measures of the medical disputes, to serve for the construction of the socialist legal state.
